OKLAHOMA CITY An Oklahoma man was sentenced late on Thursday to 30 years in prison for asphyxiating his stepfather with an “atomic wedgie” in December 2013.

The Oklahoman (http://bit.ly/1KcFPIo) reports that Brad Lee Davis, of McLoud, was sentenced on Thursday.

He originally was facing first degree murder.

On Wednesday, a judge sentenced Davis to 30 years in prison.

The former Marine maintained he did not mean to kill Denver St. Clair when he knocked him unconscious and pulled the ripped elastic band of his underwear around his neck.

Davis did not intend to kill St. Clair, who had bullied him throughout his life and had instigated the fight by insulting his mom, Davis’ attorney said in May.

Police said St. Clair’s death was a result of blunt force trauma and asphyxiation from the underwear being over his head. He also claimed that he was only trying to embarrass his stepfather by attempting the prank seen in school locker rooms and on an episode of “Seinfeld”. He reportedly said it happened in the heat of passion and that the fight got out of hand and went too far.

In fact, Davis was the one who called 911 to report the crime.

Authorities also alleged that Davis sent a text message to a friend before the fight, writing that he would hurt St. Clair because he had “nothing to lose”.
