Police believe he severely beat Garcia after the boy took a piece of birthday cake that didn’t belong to him.

Oriana Garcia, 26, the mother of Jack Garcia, and Jacob Barajas, 23, the boy’s uncle, were charged Monday, July 13, 2015 with second-degree murder in 9-year-old Jack Garcia’s death, Hagerstown Police Capt. Paul Kifer said in a news release.

It is unclear when the details emerged that Garcia had eaten birthday cake without permission and somehow this sent Wilson into his murderous rage.

The mother’s brother told police the boy was handcuffed on Tuesday as punishment for stealing the cake. He says Wilson then pushed the boy around and hit him several times in the stomach.

It’s not clear whose cake it was, though the boy had had a birthday three days earlier on June 27.

When paramedics first arrived, police say the boy’s mother met them outside and said her son was simply “congested” and turned them away.

When paramedics were called to the home again four hours later, they found Jack unconscious and with numerous bruises and cuts.

Jack died July 5 in a Washington, D.C. hospital. Wilson was charged in connection with the alleged beating of Jack, but the charges were filed before the boy died.

Authorities believe both Oriana Garcia and Barajas had participated in past physical abuse of Jack as well. Wilson was previously charged with first- and second-degree assault, child abuse and reckless endangerment.
